What is the name of your state (only U.S. law)? oregon My father passed away at the age of 52,he worked his whole life,he and my mother where married aprox.30yrs ago and have been divorced aprox the same amout of time. I am one of two that my father fathered with my mom,. Right now i am 42 and my yoounger brother is 35 we are both unemployed and struggling,
. Recently i have found out that my mom is clocting a SS check from benefits from my father my mom has not worked legitimately a day in her life,also note that my father also served in the military and was honorably discharged,
. Me and my brother feel we should be the benefactors of our fathers ss benefits and not our mom who has been divorrced from him for over 25yrs and was remarried twice since the. Could someone please tell us if we have a legitimate claim to our fathers SS benefits ??

No.

Only minor children are entitled to benefits on a parents SS credits. Able bodied adult children are not.
