Hi,

How do I modify a Motion (and Declaration) which has not yet been heard?

Background:

Yesterday I filed a Motion, Application for Order and Declaration in family court and served the papers on the respondent. The hearing is set for December.

In my motion, I requested attorney's fees but I just found out that my attorney's bill was higher than the amount I requested in my motion and application for order.

To request the correct amount, do I change the figures, add "FIRST AMENDED" to the title, and then re-file and re-serve all the papers?

When I file my revised papers, do I have to call attention to the change and explain why it was changed?
