What is the name of your state (only U.S. law)? South Dakota
Is a conversation with police over the phone admissible in court? no arrest or charges have been made.

Yes it is in most cases. Both the tape of the conversation and in most cases the even testimony by the police about what the party (if he was in fact the one charged) is admissible.
