NC- In July 2010, my wife had some minor driving citations dismissed, via retained lawyer. This past Thursday, the sherriff's dept. came to our house and took her to jail. They issued warrants for Failure to Appear, She has never been in any trouble what so ever , she was taken to the jail, $20,000 secured bond and was there overnight. Dismissed the next day, but she is unable to cope, she is litterally a wreck over this. Can we be compensated?

No, you cannot be compensated.

Sorry.

Compensated by whom? By the attorney that said the matter was resolved and was not? Perhaps. It all depends on whether he committed malfeasance or whether wires simply got crossed. Unintentional errors may not be subject to any civil claim.

The sheriff's office would be clear so long as they acted on a warrant they had good cause to believe was valid.

If she feels some form of malfeasance or intentional misconduct occurred, she can speak with an attorney as to her options.
