NJ- I have a friend who's boyfriend was selling cocaine and it is his second offense. The police found it in the house that they both lived in, the storage unit that she rented along with a new truck and a lot of money. The house was raided and everyone in the house was arrested. Including her 3 children ages 17,18,21. The 17 year old was released the same night, the two others were kept for a week. The boyfriend originally claimed it was not his and he didn't know who they all were. However, once they arrested the 18yr, 21yr, and the girlfriend, he decided to take all charges. They are still keeping her locked up for the last month and we are thinking that they will try to get her to get jail time also. There was supposedly 5 ounces found within 3 school zones. I am really wondering if she will get time, since the house and storage unit is in her name, the truck that is in her name was used to make transactions and drugs were found in the house and in the bedroom. Will she still get charged if he takes all of the charges?

Is her defense going to be that he held a gun to her head and forced her to assist him in his drug sales? Unless she can convince a jury that she is a complete idiot and had no clue of his activity, or he forced her to be involved, she's liable for at least a conspiracy to commit the sales (or whatever appropriate aiding and abetting offense might be applicable in your state).

She needs a good attorney. She might fare well if she and the kids agree to testify against him.
