I Was Arrested...

What is the name of your state (only U.S. law)? Florida

Hi

I was arrested and released on my own recognizances for Battery-Touch or

Strike statute violation # 784.03(1a1). I had an incident with a

hairdresser over my son's haircut and she chased after me in the parking

lot of the salon and she says I hit her with my purse. I may have while

she was AGGRESSIVELY walking by me and I was trying to open my purse. It

is a very small purse (6 inches long by 4 inches wide) and only a few

LIGHT items in it (a glass case, hand sanitizer, pad and paper, kleenex,)

I had my car keys in my other hand, so nothing was in my purse. Again,

she was the aggressor and I was very angry and she was screaming like a

banchee at me---I did PAY THE FULL PRICE FOR THE HAIRCUT, and I was

going to leave... she called the cops and I left, but there was a cop right

across the street so they pulled me over down the road.

They said she had 2 witnesses, but I don't know if she's lying or not. My

son didn't see anything as he was still in the salon, so I have NO

WITNESSES!! So She pressed charges against me for BATTERY....

I was arrested and taken to jail in 1990 (20 years ago) in Fort Myers FL

Lee County for a domestic incident (my ex stole my cat- he would not give

him back to me- neighbors called the cops- and I wouldn't leave without

my cat when the cops told me to leave, so they arrested me (again

STUPID). THE CHARGES WERE DROPPED IN COURT--

Other than these 2 incidents I have not had any other problems with the

law, not even traffic violations or accidents I am 52 years old- I have

never had an accident or a traffic ticket in MY LIFE- tonight was the

first time in my life that I was even pulled over by the cops...I am an

older- decent- law abiding- single parent and this CAN BE ON MY RECORD

permanently**************

My questions are:

1. What should I do now?
2. Do I need a lawyer? I can't afford a lawyer, so what are my options if
I need one?
3. Should I just go to court and plead NOT GULITY??

My court date is coming up soon...PLEASE HELP I DON'T KNOW WHAT TO DO
NEXT!!

well, what do you want to do. Right now it's a lot of sit and wait for the court thing

I would suggest you have a lawyer. If you cannot afford one, ask for a public defender in court. They will review your financial status to determine if you are eligible.

3. Should I just go to court and plead NOT GULITY??
well, that is where you would generally then ask for a PD so unless you want to just admit guilt, that would be a good thing.

btw; it matters not if you had a brick in your purse or nothing; an unwanted touch is a battery.
