I hope this isn't much of a bother, but I have a question about an accident that has occurred recently, in which I partook. We had come to a stop at a two way intersection, and proceeded to cross the intersection after waiting for a vehicle to turn. As we were crossing the intersection a vehicle coming from cross traffic, which was speeding, proceeded to t-bone us. None of us (those present in the car t-boned) had seen a car when initially proceeding to cross the intersection, and furthermore the vehicle that had hit our party had made no signs of attempting to avoid the accident (i.e. braking or swerving). There is a camera that has the accident on tape. I would appreciate any help possible, especially if anyone could list current court cases or links that hold relevance toward this case. Did the other car have the right of way? Absent some compelling evidence that they were travelling at excessive speed, you'll be liable if they had the right of way.

I had a similar instance where the police investigating the accident determined from how far my SUV was knocked through the intersection that the other vehicle was travelling over twice the speed limit. Even then it was hard to collect form the other party's insurance.
