Is it legal to hold assets in trust until the death of a non beneficary?

That's not a very clear question. Not sure what is behind your question about someone who isn't even a beneficiary.

What a trustee can do with trust assets, are dependent upon the directives documented in that particular specific trust. That document indicates under what circumstances a trustee can, or cannot distribute assets, as well as the discretionary latitude the trustee has. There's not a generic answer applicable to all trusts.

While we usually talk of life estate in regards to real property, there can be a life estate on any property. The measuring life can be anyone.
