Hi and thank you for any of your time in advance,

I live in California and my son had ran into the street at a car. The car swerved up on the curb. I had called the police which had dealt with my son. The other party called me letting me know their car was damaged and not driveable. I checked with my insurance, but they won't cover it because he was not in a car. My son is 18 living at home going to school. Am I liable? Is he liable?
