What is the name of your state (only U.S. law)? WV

I recently settled a PI claim and have been waiting on word from Medicaid concerning the amount of their subrogation lien. I understand that Medicaid is only entitled to 1/3 the TOTAL amount of settlement maximum. Why can't my lawyer hold that amount of money in trust and disburse the rest to me minus his fees and other expenses, of course!
