My mom was hurt on her job in 1999, she has two claims
agaist her employer. her first injury was in Jan. took
the insurance co. over a year to okay her surg. her second
one is on her back, she cant even pick up her only grandson
not to mention my little brother. They have demoted her,
transfered her to different stores further from home,
when hired in she was to work no Sundays and no Nights,
They are now harrasing her to work both,While receiving
workers comp. can she also not get her short term dissabilities? Also the doctor that did her surg. on her
right shoulder will not see her anymore and she is still
in pain with loss of her right arm, Her doctor for her back
isint doing her much good either,she has three buldjing disc,with bone spurrs.She works for a store called bi-lo,
their insurance co.along with managment has been beating
around the bush, trying to get her to quit or be fired.
Knowing she cannot work on Sundays or night shift, they have been scheduling her anyway.Shes been in many of their
stores and now at a new one @ Signal Mtn. they are giving her a hard time,can they push and push her like this?
The Doctor treating her for her back had her take an FCE
test,that night she past a blood clot the size of a nickle,
went to her own private physician and was told she had
busted something inside her rectume due from this test
which involved pushing,pulling,lifting,and climbing.
Why do people treat W/C patients like there dogs,liers,
drug addicts,fakes frauds??? I cant understand this world
we live in today,If this is Justice this once again i know
now why some just end up getting justice on there own,
Laws suck when it come to those that get hurt on the job.
Id like to know..Who can they trust? Why do they not get
the treatment they desearve?Why should they have sleepless
nights due to pain?(while the dr.s get a full night sleep)
IS THERE ANYBODY OUT THERE THAT STANDS UP FOR W/C VICTOMS?
IF SO WHERE ARE THEY?THEY WANT TO WATCH THEM,INVESTIGATE
THEM, MAYBE THEY SHOULD ALL BE WATCHED THE DOCTORS, INSURANCE CO. EMPLOYERS, INVESTIGATE THEM!!!!NOT ALL PEOPLE
THAT GET HURT ON THE JOB ARE FRAUDS,INSURANCE CO. SHOULD
BE SUED FOR THINKING SO..DOCTORS ALSO....
HOW CAN THEY DEMOTE HER AFTER WORKING THERE FOR SIX YEARS
JUST BECAUSE SHE GOT HURT-THEY USED THIS..SHE WILL NOT WORK
ON SUNDAYS,WHAT A JOKE SHE NEVER HAS AND THEY KNOW THAT!!!
JUSTICE????? DO WE STILL HAVE THAT IN THE GOOD OLD USA??

that scenario sounds familiar to alot of unjury workman comp cases. there are some things you can do. first is to get some legal advice, hire a workmans comp attorney, now be careful who you get. a lot of attorneys dont really look out for your best interest, ask a lot of questions and ask about the options and possible outcomes of dealing with workmans comp. second, find a new doctor, the doctor should provide her with work limitations for on and outside the job, have her explain all the things that give her pain, lifting, twisting, climbing, bending over, any symptoms from the accident. her employer is responsible for providing work w/in the restrictions, even if its as mundane as shuffling paper. unfortunately the company can make it as difficult as they see fit. have her keep records of what and when and who did what to make her job difficult, be low key on this. this will help out later on when and if you have to go infront of dept of labor or the human rights commision, this usually happens if there is harrassment and termination of your job due to the injury. stay strong and keep a level head...good luck..
