MGL 94C s32L determining possession

What is the name of your state (only U.S. law)? MA

Hi,
I am wondering under MA new law MGL 94C s32L, if police find more than one person high, and find one ounce of less of marijuana, how do they determine who is actually in possession? Can all present be charged with possession?

Everybody who as constructive control of the drug can be charged with possession. It doesn't matter if you have used it. It doesn't matter if you are the owner. It doesn't matter if someone else in the room is stoned out of their gourd.
