What is the name of your state (only U.S. law)? New York, The person has not been charged with a crime but was arrested and released and the other people were picked up and charged with federal drug conspiracy. My question is can the persons lawyer negociate with the prosecutor so he is not charged if he becomes a confidential informant or what are the probability they come looking for him because he checked with a cop and doesnt have a warrant

Someone can avoid prosecution through making a deal, sure. But, if he fails to uphold his end of the deal they can always resurrect the charges. The statute of limitations can be one or more years depending on the nature and jurisdiction of the offenses.

Is it even worth it and how can the best deal be negotiated. Can a lawyer negotiate the terms would that be wise
