I signed a contract with a contractor for a addition on Nov 15th and he asked for $11000.00 up front. So far he has not started on the addition, has not even bought the materials yet, the completion date on contract says 03/28/2011. He never contacted us over the winter to say he will get started as soon as weather clears. We contacted him in Feb he stated we would be the first on his list. Earlier this week we called and after leaving numerous messages he called back and said he would come up today to discuss the work. When he arrived today he was here for about 10 min and didn't even measure for the window he needs to special order and told us that he didn't know when he could start because he didn't know when excavator would be available We also found out thru the township that he is very busy right now with other jobs, confirmed this with blocklayer he has working for him. He is busy all next week. Do we have any rights here?

well, obviously he isn't going to meet that date.

what do you want to do?

are there any provisions in your contract for cancelling?


are there any actions addressed should the work not be done by 3/28/2011?
