What is the name of your state (only U.S. law)? Mississippi.
Here is the situation,I had H&R Block do my taxes this year so I could get my Refund back sooner because I am a single parent and needed to pay off some debts. Upon completion of my return I was told I could have my money in 8-15 days upon acceptance of my return through a Refund Anticipation Check or prepaid master card from H&R Bank. All I had to do was sign this form and they would deduct my fees owed from refund amount and issue me a check. The cost would be $32.95 + 20.00 check fee and this fee guaranteed my money in 8-15 days. I agreed signed the documents and got copies of all paperwork.
On Feb.15 H&R Block notified me that my return was accepted and my check would be available to pick up in 8-15 days. Now it is March 23,and I still have no check, the IRS says my tax return is accepted and processed. H&R Block now says they make no guarantees and that I will get my money when it is sent to them.
I have all documents stating otherwise,I know the definition of anticipate, and all their ads state this guarantee. That is why I used them, and they charge a fee for it. All attempts locally, through the owner, and corporate office says that they make no guarantee and the documents do not say they do. What legal action can I take? How many other people out of 2.1 million returns they do each year has been conned to,and are told its not their fault its the IRS whose is at fault. Help I need my money!!!!!

If you don't get your money before the government issues a check to H&R Block, I have no idea what you paid for. Perhaps, rather than demanding your money, as what it is you paid for.

The fees they charge u for is for their possessing and issuing a refund anticipation check to u by their own bank I.e.H&R Block Bank, and they open a account in your name to route your refund to their bank to insure they get their money. If u don't pay the fee then they don't guarantee u will receive your refund. The Refund anticipation check application that is signed by both parties states the check issued is based on the amount accepted by the IRS and if the amount was less than the amount of the check that H&R Block can pursue collections.
Now if I had to wait till they got their money from the IRS the check from H&R Block would be exact and no need to pursue collections. It also says that the Refund Anticipation Check is how they guarantee your money in 8-15 days because it is from their bank not the IRS.

Using the tax return that was filed, it'll tell you if the refund is held up the by IRS or if it was issued already to H&R Block. Start there.

Guys the question I am asking is,H&R Block advertises on tv and their web site, that they guarantee that u will have your money in 8-14 days. When u go to their office and have them prepare your taxes, they then tell u,present it to u on paper, and even gives u a chart with specific dates showing u when u could have your money back guaranteed. But in order to do this u have to sign this application, get charged additional fees for processing you a check from their bank, and then tell u that by doing this that u are guaranteed to have your money once the IRS accepts the tax return. Not when the IRS sends the check to them. They say that they can do this because they have their on bank and that allows u to not have to wait on the IRS.
So do I have legal action against them since:
A. I paid for a "refund anticipation check" from H&R Block based on the accepted amount on my tax return.... And that this check is not exact and if amount is different from the IRS when it is sent to them, they can collect.
B. I was given a specific date that my RAC was to come and it hasn't.
C. And I have signed documentation stating that I will be receiving my RAC from hr block on a specific date, and nothing in writing no place that says only if they have the money from the IRS.
How is this not fraud, breach of contract, and false advertising. If not them why do u need them, like yall said cheaper to do it yourself and still wait.
Do I not have legal action from them misleading and lying to me to get me to use their service????

If you have it in writing that you get your money once the IRS accepts the tax return then:
If you don't get your money before the government issues a check to H&R Block, I have no idea what you paid for.
If the return has been accepted and they have not given you your check, then you deserve damages. Here, you might tell them you will get a payday loan and charge them the interest until they pay you. Don't do that, but see what they say.

It's called breach of contract, not fraud.

Yes I have it in writing on several documents,I even have a chart on the front of my application and agreement for the Refund Anticipation Check. On that chart it says date of IRS acceptance in one column and date to receive your RAC check.
Also, now when I call the 1-800 number and choose check the status of your refund after I enter my info it says "HR Block has no information in our system for the info entered" . So I went from getting a email telling me when the IRS accepted my return from HR Block to now they suddenly have no info on me,and can't tell me in customer service wwhat is going on.....what can I do now, what steps can I do to pursue this.

That the 8-15 days can not be honored if the return is held up by the IRS thus changing the acceptance date..... That has not changed.....
