Old job injured, new job waiting for release

I am a Police Officer in a small municipality around the city of St. Louis, Missouri. On April 7th, 2001, at 0130 hours, I "Jammed" my left thumb while putting a subject in the back seat of my vehicle. Now, I began my vacation 2 days later, and one week prior to the injury, I had turned in my resignation to begin on 04/23/01 because I had just been accepted at another police department in the area. My question... Four days after the injury and two into my vacation while still on the payroll with my original employer, the pain in my left thumb became unbearable. I went to the emergency room for an evaluation... The doctor placed my hand in a splint, and began directing me to a specialist, and possible surgery. I began to worry at this point, I thought, when I hurt my thumb, vacation was active, so I would use the two weeks to rest and heal, but with the possibility of surgery, this would interfere with my new department. I immediatly returned to my department, and filed an accidental injury report, and began processes for workmans comp. I then contacted my future employer, and they were understanding with the situation. A full vote was made before me (splint and all) by my new city's board of alderman to hire me full time, all I am waiting for now is the swearing in. My concern. Today, I returned to my doctor, and fortunately, no surgery, but I am not allowed to return to full duty work until May 23rd. I have not yet been sworn in with my new department, and as of yesterday, my resignation became active with the old city I was employed by... First, will workmans comp still cover my financial status until May 23rd under my old employer, and second, eventhough I have not been sworn in, can my new employer "refuse to hire me" as a result of my injury sustained at my old employer's location. If it wasn't for getting the job with the new department, I would have never turned in a resignation to begin with... Any advise on if I am safe would be greatly appreciated.
