hi,

i am working in a IT consulting company and the company says it is declaring bankruptcy (chapter 7), but has not filed in yet. this has been continuing for several days and resulting in tremendous mental harrasment for most of the employees. the company has not given the termination letters yet and is not even paying the salary. we need to know what can be done in this regard from the employees point of view. the company was doing very well and suddenly says it is filing chapter 7. the company has no products or such things by which if fixed assets apart from office facility , so that the company can sell things and pay for the debts.

can the company send back dated termination letters and say that you are terminated from a week back. there has been no written communication that the company is declaring bankruptcy nor the termination letters have been given to us.

due to this there has been a lot of mental harrasement and due to which lots of things have been hampered. physical health of people have also started hampering due to mental tensions.

we need advice as soon as possible and need to know if we can sue the company. the company belongs to a single person and does not have a great strength of people.
