And to answer your question, your purchase and (attempted) importation of the counterfeit merchandise is actionable. They can and most likely will sue you and you have no defense. The fact that customs intercepted the contraband before you were able to profit from it means squat.

I think what aram is saying is that he never ordered NHL merchandise to begin with. So he could not "rat out" a supplier that does not exist.

He may have ordered NFL merchandise but since the NFL isn't asking they why should he comply.
