What is the name of your state (only U.S. law)? Arkansas/Kansas

My husband is on Disability due to a Stroke in 2009. He has $470 taken out of $1134 every month for child support. We found out today that his children can receive a benefit through Social Security due to his disability. Will that benefit count towards his child support or is that just additional money that will be paid out and he will have to continue paying the full amount?

Your husband should go back to court and ask that his ex be made payee of the dependent benefits and that that benefit count fully as child support.

He or his X should set that up through SSA Office nearest him .

Perhaps the dependants can get retroactive benefits also .

If he were in arrears he could also ask the court that those benefits be credited toward arrears..
