A federal income tax refund can be seized for back CS; however, the paperwork has to be filed in the fall before the refund is anticipated.
If CSEA has seized the tax refund of a couple, there is an injured spouse form at the IRS website that can be used to get the refund due the spouse (but not the one behind on CS).
