Kate Spade case is selling for $40. But these cases (http://www.amazon.com/Contour-Design-Spade-Iphone-01686-0/dp/B005LSTPQ6/ref=sr_1_2?ie=UTF8&qid=1336135563&sr=8-2) are selling for <$10, obviously they are not the real thing.

My question is whether it legal to import and sell such cases (Since amazon is selling it).

Amazon is NOT selling it. Some goofball called "Sixth Design" is the seller, they're just renting retail space from Amazon.

If these are not the real Contour Design cases, then yes it is illegal to import or sell them. Just because someone appears to be getting away with it doesn't mean it's legal..

I disagree.

If you click on 'add to cart', and 'buy', you end up buying the item from Amazon. Sixth Design may ship it, but if you look at your credit card statement, your purchase is from Amazon.

I beg to differ, but it really doesn't make any difference to the problem. Whether Amazon or one of their hosted ecommerce business sites sell it, it doesn't indicate that it is legal.

kate spade designs its own casing. This shop called "Contour Design" (Although it shares the same name as a Danish company, it is actually a HK company) seems to have designed their own version of kate spade casing.

In the past, I used to see perfume called "Versace Blue Jeans BY XYZ Company". It is selling at a knockoff price and it seems legal. This contour design seems to be using this strategy?

Contour Design is a New Hampshire company that makes iPhone/iPad and laptop cases and accessories. They've been around a long time (of course, if these are knockoffs of Kate Spade, they can also be ripping of Contour's name).

As you see, there is no kate spade mentioned. I think this is just a Hong Kong company with the same name
