florida/home....two family members inherit home 50/50..one wants to move in and claim homestead exemption..the other lives in another state and wants to rent it or at least a portion of it to help pay the remaining mortgage.....also can the one live there rent free if the second one cannot rent his portion...both will be splitting mortgage cost 50/50....they do not get along...who has the say so....

Assuming this is a 'single family home', it sounds like the only person who will have the "say so" will be the judge in court. It sounds like that is where this is going to end up.

I would suggest that one of you make arrangements to purchase the others interest. It will save both of you a lot of trouble and future legal expense.
