I am the wife of a Chef in upstate New York. My husband sustained a back injury at work on Dec. 16th of last year. He has been out of work since that date and had no problems getting his worker comp checks until he saw a doctor that the insurance company made him go to. When the doctor reviewed everything from the specialist my husband had been seeing he agreed with the findings and suggested as the specialist had that surgery was appropriate and needed. One week after seeing that doctor the insurance company cut my husbands worker comp check in half. We have not yet spoke to an attorney because everything up to this date has been paid for and the claim has not been contested. The specialist has my husband listed as temp/total disability unable to return to work. The workers comp doctor agreed with the findings and recommened surgery so we are wondering why the checks are now only half his regular rate. My husband has a herniated disc, a pinched nerve and bulging disc. He also has Degenerative Disc Disease. Please advice

Unfortunately, the "degenerative disk diease" just might give the insurance company an "out." You must see a workers' comp. attorney PDQ. Do not wait. You let the insurance company "warm fuzzy" you. Don't let them sand-bag you now.

Thank you for the reply buddy2bear. We found that they can cut the check in half until the day he has surgery, then he becomes total disabled again and they have to go back to the full amount. We know nothing about workers comp and have never had to deal with this before. This is very frustrating. If they had not stalled in the beginning I am sure surgery would be over by now and Chef would be on his way to recovery. Now we are waiting on a surgery date, which should be set on June 5th. We speak to the attorney again on June 4th
