My work allowed me a 9 month leave when my son was diagnosed with cancer. My return to work date was set at August 1, 2001. My son has finished treatment and I have requested to return to work. The president of HR informed me today that they have nothing available for me and my return to work depends on another employee. If she returns to work from maternity leave there will be no opening for me - if she doesn't then I can have a back up position. Since I am requesting to return to work before my leave is over - do they have a right to refuse me work?
