DOES A SPEEDING MOTORIST HAVE THE RIGHT TO SEE THE RADAR GUN?

I live in Texas, my daughter was pulled over and supposely clocked at a speed I feel she simply could not have done. She asked to see the radar and the officer refused, told her tell it to the judge. I need to find where in the law you have this right. The local police state they don't have to let you see it, you just have to take their word for it.

Can someone point me where this law resides, penial code What number of Texas, is it a federal law and right etc.?

The simple answer is no. In 1992, the U.S. Supreme Court ruled in a Kentucky case that defendants do not have to be shown the radar gun. It is mostly a safety issue, most radar gun are powered from the cigar lighter and the officer is not allowed to let anyone to have access to the front seat of a patrol car. All the info concerning the radar gun is available to you if you know how to use it. It would be recommended that you hire a local attorney familiar with your local laws if you wish to challenge the citation.

That's right....the US is a "police state" and the police can do whatever they want. We just have to "yes sir" what the police say or do and live with it.
