My nephew was charged with statutory rape when he was 18 (he's now 24) in the state of GA. He was sentenced to 6 months plus 10 years probation. Recently, while living in TX, a girl there accused him of sexual assault. There was no evidence, just he said/she said. The girl recanted but because she is 17, still a minor in that state, he was charged with statutory rape again. His attny advised him to plea, based off the fact that he had a prior. When he did, he was automatically in violation of his parole in GA. Now he is facing time, first in TX, then in GA. All this because he had sex with two girls, both consentual, but minors. Again there is no proof against him in the TX case. Please advise on his best recourse.
