I am a state of vermont employee. Our contract states that overtime worked on weekends and holidys may be taken as comp time. It states that the state will comply with the FLSA. It states that we have two years to use the comp time. The superintendents limit the accrural to 40 hours, in spite of the contract and law. Payroll generaly follows the law. Is there case law that would support officers attempts to accrue the 480 hours indicated in the law?
