i live in north carolina. on december 17, 1996, i was in a car accident with the people from work. on tuesday morning's we go out and view the new listings, so i was on the job. i was sitting in the back seat and we were topped in order to turn left. a truck came up behind us and didn't stop. he hit us. i went to the emergency room. they exrayed my neck and butt. 2 weeks later i couldn't move my neck. i didn't file worker's comp at that time because i didn't think i was hurt that bad. i went to see my doctor and he thought i had whiplash (cervical spinal sprain). he treated me with medicines for 5 months then sent me to a specialist. the specialist xrayed me and said my spine was military straaight which meant a cervical spinal sprain. he sent me through a month of threpary. the pain was still there. he wanted to wait another month to see if i got better. my arm started going numb in july 1997 so he sent me for a mri. they found out that i had 2 ruptured disk in my neck. he got me an appointment with a neurosurgeon for august 1997. he said the disks were pushing my spinal cord back and i could be paralized. i called the man's insurance and they said he didn't have enough insurance to cover my injury, so i had to file the workers comp. i had the surgery in october 1997 and i haven't gotten any better. i have gone through acupture, threpary, neurosphysocily (?). i hired a lawyer (but i don't think he got me a fair deal). i have paid for alot of the medical out of my pocket and through my husband's insurance. workers comp didn't pay for any of that. i had to take time off of work through my lunch hours and vacation. i received none of that time back. i also didn't receive any traveling expenses. the doctor gave me 30% disability. what i received was $30,000 from worker's comp for the disability and they allowed me to keep the $25,000 from the man's insurance. (that was in march 2000). (my lawyer took his share). in the meantime i am still having alot of trouble my arm still goes numb. i have to take 4 different medicines all the time and have to take tynenol pm to sleep because i can't sleep without taking something. in the last 6 months, my throat feels like it is closing up ( a choking sensation). i had a barrum pill swallow test done. when the doctor read the xrays, he tole me i had 2 clusters of bone spurs, arthristis in my neck, bursitius in my shoulder, my neck is detriorating. he said basically my neck looks like a rocky road and would get worse. i'm only 39 years old (35 years old when the wreck occured). is there any way i can go back to workers comp and have them pay me more money? is it worth pursuing? please let me know. thanks, madonna thompson. my email address is [email protected]

Going back to workers' comp., I think, would depend on whether you "signed off" when you settled. There might be a chance that your attorney had workers' comp. keep the case "open" and that what you received was only a partial settlement. I would suggest that you go back to the attorney and ask him.
