State of Missouri, Saint Francios county. Son, 19 stopped by police two underage young ladies in the vehicle, each had a beer in hand, the driver, my son did not. Although he told me he had a beer earlier that evening he had not drank within a hour of driving. He was charged with minor in possesion and a DUI he was administered a breath test and the result was a .002 no blood test was given nor was he ask to walk a line. The Officer only moved his finger in front of his eyes to check response. Can he be issued a DUI without being tested? And if so is it because of a Zero Tolerance Law?
