I live in Texas. My husband was injured on the job on 5/29/99 and has been out of work from then until Jan 2000 when he went back to work the first time with no problem, then developed additional problems and had a second surgery 08/2000. He was released by the doctor to return to work on 6/9 and it is now 6/25 and the company will not give him the okay to work. He travels with his job, is a welder and his crew is in Phoenix AZ, so he went there. His crew foreman says that company policy is not to hire anyone back that has filed suit against the company. The company he works for has a private insurance company, NOT WORKERS COMP. Do the laws differ if the corporation HAS PRIVATE INSURANCE IN lieu of Workers Comp? Will it fall in to the Workers Compensation Act: Discrimation Prohibited Sec. 451.001? HELP!
