My Mother's husband died without a will. Does she have any rights in Texas.

I am wondering she is on the truck note and her husbands kids (not hers) want that to go into the estate probate. Does it have to?

What type of things need to go into probate? Are the things that she bought with him part of the probate?

She does have rights. As Texas is a community property state she is likely the owner of half the assets accumulated during the marriage (other than by gft or inheritance) and possibly those acqired before. She really needs advice from a Texas Attorney before the kids bully her
