Help Needed...

I live in Norther Michigan and have a few questions..Two years back (7/23/99) my grandparents deeded the house over to me (wanted it to go to me). Since then my grandfather has passed and my grandmother is now in a nursing home. My mom is being a real B^#(% and has power of atty. over her. She had it put in the will (the will was done in the last month) that I would get the house and that I would not be able to sell or borrow monies for seven years. Can this still hold? What can I do now? She has already come in and ransacked the place and taken what she wants. Can I move in now, isn't she trespassing??? Any help would be greatly appreciated. :(

What is the date that you had the deed recorded at the County Recorder's Office ?

Then, Mom can go jump in a lake. The house was already yours, in "fee simple", since 1999. Therefore, the property no longer belongs to Grandma, and since the property no longer belongs to Grandma, any further stipulations to the land, house, or otherwise, have no force or effect.

Mom is kinda dumb, isn't she ?

Next time you see her, tell Mom that the next time she enters your land and home, you'll have her arrested for trespass.

That's a different story. Like I said, no one can come into YOUR home and "ransack" it, without your permission. Nothing comes out of that house until such time as Grandma asks for it herself, or until she dies and the Will is probated. When the Will is probated, then the Court will render an order concerning the contents.

Until either one or both of those occurrences happen, you should stand at your front door with a shotgun and say, "Go ahead Mom, make my day !"

Thanks again for all your help...She got the keys before my grandma went into nursing care. We were talking at the time. I'm sure I will be having more problems down the line...The funny thing is...my grandfather died of asbestotis of the lungs and my mother has been the personal represenative for the last 8 months. She has been given, or it will state in the will that she will recieve my grandmothers half of the settlement...settlement not done with yet...but the best part is is that she wanted to clean the house out....said she wouldn't leave a damn thing in the place. She even laughed becuase the pump went out. And said well thats Jenny's problem...its her house. It comes unfurnished, said I couldn't borrow against it..haha...I know its greed...Im a grandchild and shes a daughter.

Okay, the first thing you do tomorrow morning is get a locksmith out there and change all the locks and add deadbolts to everything that's on hinges.

One more thing - - when you talk to Mom again, please tell her to "Bite Me" for me too, will ya ?

Then, you move in.

Thanks again..you've taken a huge headache away and stress off my shoulders..my grandparents said I would have to fight for it...I've handled much more..been on my own since I was 16...found out my dad wasn't by bio...something more to add on...

Well She has royally screwed me....

Well, I went over to the house this afternoon and everything, well almost everything had been cleared out. We changed the locks and deadbolted and padlocked everything else. I will be able to see my grandmother tomorrow and I will find out if she has told my mother to clean everything out, if she hasn't I will have her cited for trespassing, and hopefully she will have to return everything. She even went as far as to take things that my grandfather gave me that had my name on them...well that I will report to the authorties...I will get them back...come hell or high water....the very worst part is...how can a mother do this to one of her own children? And then my hurt and hatred for her right now wants me to f&^k her royally...and I know just what to do...Oh yeah in the meantime my home equity loan is going through I will make it a point not to be able to get over there until we go shopping for new appliances and furniture...that way I have the cops escort her there and hopefully have the company truck moving all of the new in as she's taking the old out....that will really piss her off...ya think? Sorry ma, the bit in the will wont work....................hahahahahaha
