my dad died 6/22 in texas.survived by 3 children,no wife.no will so tried small estate affadavid but one daugther would not sign and just found out see wrote 10,000 worth of checks after death and was not on account. police said since she lived in house she could say she had permission.any help to stop her stealing any more?nitty47@hotmail .com:confused: :mad:plan on filing for administor on tuesday but what can i do while waiting on courts

What is the status now of her access to the account--can she still continue to write checks or have you all complained to the bank so they can stop accepting her checks?

If someone in the family has not already done so, someone needs to file with the county courthouse to be personal represenative/administrator of the decedent's estate, and that person will then receive legal papers authorizing him/her to act in claiming any assets on the decedent's behalf. The personal administrator could then claim whatever money is left in the account to close it out, to use this money to pay off any outstanding estate debts and funeral expenses and taxes, and then distribute the rest among heirs.
