can anyone tell me the federal laws regarding inheritance issues if your spouse is not a citizen of the united states?

my mother has never become a citizen even though she has been living in the united states for over 40 years. can my parents estate be affected by this?

My response:

Citizenship has nothing to do with Estate matters or Inheritances.

There should not be any inheritance problems, but there could be estate tax issues if their estate exceeds the maximum exemption amount which is currently $675,000.
