Father passing away, what about my deceased brother's things?

My brother passed away in 1990 and my mother passed away in 1991. As far as I know, there was no will for my brother or my mother. My father remarried in 1994. I moved out in 1993 after I got married but alot of my stuff is still in the house. He is now dying in the hospital and He does have a will and from what I'm told that I, my step-mother and the church are to split his estate into thirds. My question is can I still take whatever belongs to me and my brother without any legal recourse? And what am I entitled to before he passes away?
