North Carolina: Mother passed away in March 2001. I received her Federal Income Tax rebate check for $300 in the mail. Can this check be deposited into the estate account or do I need to send it back

DEAR NTMA:

If you are not the executor of her estate, then you should give the check to the executor. If you ARE the executor, then you can go ahead and deposit it into the estate account, but be sure to check with the customer service clerk at the bank first, to determine how it should be properly endorsed on the back. The executor has the legal authority to process all assets of the decedent.
