My Spouce/I set up our wills in Virginia in 1982, we are now in New Hamshire and have lost track of the named Executrix. We want to name a new Executrix and our current address. Do we have to complete a new will at $$$$$, or can we ammend our current ones for the above purpose with notary?

DEAR DWM:

It would be far wiser to pay a New Hampshire probate attorney the couple of hundred dollars it would take for him/her to review your other will to revise it to conform to New Hampshire law (which will apply if either one of you dies there). If it was not examined, then there is a strong chance it could be rejected as invalid, which could cause serious consequences that you did not expect or plan for.

It is also be advisable to have an executor who is situated locally in New Hampshire who would be much better suited to handle your affairs, so your desire to name a new executor was "right on track".
