my former spouse and i have cummunity proerty in california. we were seperated for 15 years and then divorced. in all that time i did not recieve any benefits from our rental property while he lived rent free. now he is planning to remarry and wants to remain living on our cummunity property. what can i do legally:mad:

My response:

First, the word is "Community".

Second, was the property acquired during the marriage ?

Third, why wasn't the "community" property divided at the time of dissolution of the marriage ?

Fourth, was there a "Marriage Settlement Agreement" concerning your receipt of "benefits" from the rental property ?

Fifth, why didn't you exercise your rights to the property years ago ?
