my question is how long does the board of education have to do a learning disabilities evalution of your child after you have requested it in writing? I was able to locate the parental rights on the florida dept of education website but no where does it say how long the school has to follow through. we have been on the list for two years and are ready to take legal action. :mad:

If your child has special needs, then he is entitled by law to an Individualized Education Plan (IEP), which is based on the results of the evaluation.

If the school put together a plan for him without an evaluation, that plan is probably invalid and you would have a good case for due process.

Sounds like your paperwork got lost in someone's shuffle.

First, ask the school to convene a case conference committee meeting on this issue and on the issue of the education of your child. Proceed from there.
