I WAS PLANNING MY WEDDING AND HAD PAID FOR MY RECEPTION HALL IN FULL 3.5 MONTHS IN ADVANCE. THEY WERE MAKING SOME INTERIOR CHANGES & THE OWNER ASSURED ME THAT ALL CHANGES WOULD BE COMPLETED BY MY DATE. I WENT BY 1.5 MONTHS LATER & MINIMAL WORK HAD BEEN DONE. AGAIN, HE ASSURED ME THAT ALL THE WORK WOULD BE DONE. MY FIANCE' & I DECIDED THAT WE WOULD WAIT A WHILE LONGER TO MARRY. WHEN I CALLED THE OWNER, HE SAID THAT HE WOULD CHANGE THE DATE, BUT MADE NO MENTION OF REFUNDING ALL OR PART OF MY $$. WE SET ANOTHER DATE & HE ASSURED ME THAT THE CHANGES WOULD STILL BE DONE BY MY ORIGINAL DATE. THAT DID NOT HAPPEN. SO I TOLD HIM I WANTED TO GET MY $$ BACK & SAID I COULD ONLY GET 1/2 UNLESS HE COULD BOOK THE DATE, THEN I COULD GET ALL OF IT BACK. I CONTINUOUSLY CALLED WITH NO RESPONSE. I FOUND OUT LATER THAT HE WAS IN A LEGAL BATTLE OVER THE BUSINESS. I FINALLY CAUGHT UP WITH HIM & HE SAID THAT HE WOULD GET MY $$ TO ME. I HAVE NOT HEARD FROM HIM SINCE. THE BUSINESS HAS BEEN SOLD. WHAT OPTIONS DO I HAVE?

Thanks. I'm certain what the caps lock does, but here it is:
I was planning my wedding and had paid for my reception hall in full 3.5 months in advance. They were making some interior changes & the owner assured me that all changes would be completed by my date. I went by 1.5 months later & minimal work had been done. Again, he assured me that all the work would be done. My fiance' & I decided that we would wait a while longer to marry. When i called the owner, he said that he would change the date, but made no mention of refunding all or part of my $$. We set another date & he assured me that the changes would still be done by my original date. That did not happen. So i told him i wanted to get my $$ back & said i could only get 1/2 unless he could book the date, then i could get all of it back. I continuously called with no response. I found out later that he was in a legal battle over the business. I finally caught up with him & he said that he would get my $$ to me. I have not heard from him since. The business has been sold. What options do I have?

Thanks. Your post is much easier to read.

Anyway, was any of this in writing - the dates of readiness, the types of improvements that were to be made to the hall, etc., etc.?

What form of payment did you make - - check, cash, etc., got a receipt?

Do you know where the former owner is now?

The said improvements were not put in writing unfortunately. My mistake not asking that he do so.

The payment was made with a check & yes I do have a receipt.

Now, I understand, the the former owner owns another business not far from the other. I have been by there several times but there was no form of life. I think he's been laying low based on information that I received from the new owner.

My response:

Okay, since you have your receipt and cancelled check, and you probably have witnesses as to what was said and promised, I would sue, and name, the old owner and the new owner. Why the new owner?

Because when the old owner sold the business, the new owner may have purchased all the old contracts as part of the "deal" - - and once sued, the new owner might be more forthcoming in helping you to find the old owner.

Sue these miscreants in Small Claims court.
