What forms are necessary to name the guardian of my son in the event that something were to happen to me and my husband before he is an adult? My husband's sister has agreed to take care of him. We want to make sure something is in place so he doesn't have to be placed in foster care.
Also, if a guardian was not named but there was family available, would he be placed with a family member or would they have to file for custody with the courts?
