We leased two of our trucks on with a company in Tennessee. We ran for them for 5 weeks. WE received no statement of our hauls or money due us. We were told there were charges against us for late shipments, charges for our drivers not calling in to company. They also claimed damages on the produce we hauled. There was never any documentation to back their claims on. They even tried to file a $9000.00 claim with our insurance company, but when asked for proof of claim, they could not produce any documentation. This has caused our insurance to cancel on us because they claim we were out of the radius shown on our insurance policy.
After a bad ending with this company, we have found out that they had no "operating authority" for their trucking company. It had been revoked in March 2000. We signed the contract with them on June 6th.
We have never received any type of statement for our 5 weeks of haulong for these people. In fact they informed us they were broke and had no intentions of paying us. They had my husband arrested on false charges that have been dissmissed. (That is a whole other story!!)
What recourse do we have on these people??
They had us running illegal on the road, committing forgery in order to get fuel money, they ran us over legal hours, they never did drug tests that were required on our drivers, in fact they offered our drivers drugs in order to keep them awake to run the hours they were requiring them to.
The company is still operating their trucks without "operating authority".
They tried to get one of our drivers to abandon our truck in Portland Oregon and to fly him to Texas to pick up one of their trucks which had been impounded when one of their drivers was arrested for drug charges while in their truck. Their intent was to leave our truck in Portland for us to get it home.
When he refused, they abandoned him in Portland with no fuel money or personal money to eat.
After running for these people, them owing us $22,000.00 in gross revenue and not paying us, our having to take money from our bank account to get 2 trucks home from out West (WE LIVE IN ALABAMA), we have had to file chapter 7 Bankruptcy.
What can be done to these people and how do we get their operation stopped? We are not the only ones they have taken advantage of, we were told by a reputable person, there have been at least 20 lawsuits against these people for non payment.
These people should not be allowed on the road.
Please give me some type of advice!!!!!

It sounds as if these people are pure thieves. I assume you filed criminal complaints withthe police in your area, and perhaps with the FBI as they probaly broke Federal laws, and told the bankruptcy court -- as IT not you has the pre-bankruptcy claim rights. Also report it to the Federal and State Department of Transportation.
