Situation: Child with mother's last name. Birth father helped fill out and signed birth certificate agreeing to child's name. Four years pass and father decides to request name changed to his during a mediation session. This was the first time he had ever mentioned the subject and it was not included in his pleadings filed for modification of CS. 1) Can he have the name changed without consent from mother? 2) Would a Judge permit this as it was not part of the pleadings? 3) Is there any case law that you are aware of that would allow child to keep birth name? Thank you.
