I am wondering; what is the legal definition of blackmail, and how is it prosecuted, ie: what evidence is enough to be able to press charges against someone for this? Any information would be helpful, thanks in advance.

Every state defines the crime differently so your best bet is to look at the statute. Many states have their laws on-line and the public library's reference desks are pretty helpful with these inquiries.
