Child Support: Not Our Children

My fiance is embarking on an unforseen problem. Three years ago he was married to a woman who had 3 previous children and was giving birth to twins. She is now and was then on Medicaid and Welfare. They were married 3 months after the twins were born. She flip flopped between wether or not they were his (there was a "slight" possibility). They were married for 6 months and she was cheating on him consistently. He left her and she filed for divorce in the state of Kansas. She confessed that the twins were not his and declared so in the divorce papers. There are official divorce documents on file (with both signatures) stating that he had no children. Now he found out, after all this time, that she is filing for current and back child support for the 2 children. If they are not his how can he be forced to do so. We only found out about this when he found that his wages were being garnished for the twins hospital bills. We are fighting this, but don't know what to do. If the children are his then we will sue for custody and pay the expenses. Do we have a leg to stand on? In the official court documents it states that he doesn't have children, but the state is filing for child support. Oh, supposedly the state of Kansas doesn't know where she is.
Any help would be appreciated!

Because a government agency is after you, then you had better retain an attorney to sort this mess out ASAP!

You might start out by getting certified copies of the divorce that states they had no children of the marriage and providing this information to the agency that is taking his money. You also did not state if his name was on the birth certificates, if it is he may be stuck. Do all the leg work and research for yourself before going to an attorney and be able to provide all the verification to them when you go. If the divorce states no children and they were not married with the children were born and his name or signature is not on anything claiming to be the father he should be able to win and be refunded his money.
