not long ago me and a buddy was
driving from a day outing in
another town. On the way home we
was stopped and the officer
performed the feild sobriaty test
on my friend/he was driving,and he
blew a .067 %. the officer
beleived he had enough probible
cause to arrest him for dui.At
this point the cop asked me if i
could drive,i said no because i
had 8 or 9 beers that day.At that
point the officer said he would
have the car towed. I asked him if
i could pull it off the road to a
safe place until the dui matter
was resolved. at this point he
said he would[cop] and he pulled
it off to the side,so as not to be
a hazerd.we got a ride to the
police station with him.during the
search of my friend they found a
small vial (suspected heroien) At
this point they asked me to give
up my keys to the tow truck
driver,so the cops could impound
my car.the police asked me
repeatedly if they could search my
car,i said no.aproximetly 2 hours
after the dui arrest and suspected
herion they decided to do a
invintory of my car. they opend
the hatch back and picked up the
carpet,finding some contraband,pot
in exses of 60 grams.at ths point
they applied for,and got a search
warrent from the j.o.p not
mentioning the prior find.they
allso state themself's in the
police report that the searce was
improper. the district att. is
using the exigent curcomstances
for there case. How much ground do
i have to stand on
