If your child has an IEP, he is considered a special needs child and has additional federal and state protections.

The first step is to request a due process hearing, which is an administrative hearing, with your state education agency. This is called exhausting your administrative remedies.

You must do this before you file any kind of civil suit in an education case.

Consult an attorney who does special education law in your state.

Don't hire someone who doesn't know this very specialized area of law.
