I have a friend that is married and his wife lives with another man. She doesn't have a restaning order on him. He went into her house and hit her she got him charged with 1st degree burglary can they charge him with that.

If his wife lives with another man, then they have strong grounds for a divorce. If she didn't want him at her house and he was taking something, then, yes, that is grounds for burglary... at least that's what I recall being true. There doesn't have to be a restraining order for him to get a charge.
