Hi,

My son is having major problems at school and I don't know what options we have legally. His peers are harrassing him, calling him "faggot" "gay" "you're ugly" "nobody likes you" etc. My son is 13, he resents the way these kids are treating him, he tells me he is not gay, and he has started getting into trouble because he is sick of these kids and has started arguing with them to the point that it sometimes gets physical.

He came home today upset/furious because some kid(s) put something pornographic in his notebook while he was out to the bathroom, then told the teacher he had brought porn to school and he got in trouble for it.

I have 2 goals: I want to make the harrassment stop and I want to prevent my son from getting into more trouble for hurting these kids, which he thinks is the only way to make it stop.

We live in Massachusetts, there is only one middle school and one high school in the town, so trying to change schools is not an option.

Can a public school be made to pay for private school tuition?
What can we expect the school to do to prevent/stop the harrassment?
Should I hire a lawyer? What area of specialty?
Should I file a complaint with the police about these kids?

Any help is appreciated!

Child-on-child sexual harassment is actionable in court IF the school knows about the sexual harassment and fails to at least take steps to prevent it.

Talk to an attorney in your state who focuses on education law.

If your child is a special education student, you also have federal and state protections that will bolster your case.
