If a co-op purchased before marriage is retained in the sole name of the purchasing spouse, can it be refinanced in the sole name of the purchasing spouse, without the other spouse being listed as co-borrower or co-occupier? Co-op is in New York State. Many thanks.

I believe the answer is no. If the the spouses name does NOT appear on the deed than it is still the owned solely by the original owner. When you go to refinance, you will need the deed and than only your name appears on the refinance/mortgage papers.

Prior to getting married, i had my husband put my name on the deed of the house he owned before we go married

We are refinancing. Without my signature, he does NOT get the new mortgage.

I live in NY.
